Terms of Use

1. Scope

These Terms of Use apply to the use of the Zenbara app and the website zenbara.com, provided by Dreamly Colors GmbH. By using the app or website, you agree to these Terms of Use.

3. Use of the App

The Zenbara app is available via the Apple App Store and optimized for iPhone and iPad. To use the app, you need a compatible Apple device and an internet connection for download and certain features.

Use of the app requires agreement to these Terms of Use as well as to the Apple App Store Terms of Service.

4. Free and Paid Content

The Zenbara app offers free access with basic features and content (free tier). Extended content and features are available through a paid Premium subscription.

5. Subscription Purchase

Paid subscriptions are purchased exclusively through the Apple App Store. Apple Inc.'s terms and conditions apply to the purchase. The subscription contract is concluded between you and Dreamly Colors GmbH; however, payment processing is handled by Apple.

6. Pricing

The following subscriptions are available:

Premium: $6.99 per month (incl. VAT)
Family Annual: $39.99 per year (incl. VAT)

Billing is handled through the Apple App Store. Current prices can be found in the App Store. All prices include applicable VAT.

7. Cancellation

You can cancel your subscription at any time. Cancellation is done through the subscription management in your Apple device settings or via the App Store. After cancellation, the subscription remains active until the end of the current billing period. No prorated refund is provided for the current period.

8. Right of Withdrawal

As a consumer, you generally have a 14-day right of withdrawal. Since subscriptions are purchased and managed through the Apple App Store, Apple's cancellation and refund policies apply. Please contact Apple Support directly for withdrawal requests.

9. Limitation of Liability

The Zenbara app provides exercises and content for emotional support of families. The app is not a substitute for professional therapeutic, psychological, or medical treatment. For serious emotional or mental health issues, please consult a qualified professional.

Dreamly Colors GmbH is only liable for damages resulting from intentional or grossly negligent breach of duty. In cases of slight negligence, Dreamly Colors GmbH is only liable for breaches of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract. This does not apply to damages arising from injury to life, body, or health.

10. Intellectual Property

All content of the Zenbara app and website — including texts, illustrations, audio files, graphics, designs, and software — is the property of Dreamly Colors GmbH or its licensors and is protected by copyright.

Any reproduction, distribution, modification, or other use beyond the limits of copyright law requires the prior written consent of Dreamly Colors GmbH.

11. Data Protection

Information about the processing of personal data can be found in our Privacy Policy.

12. Changes to Terms of Use

We reserve the right to amend these Terms of Use at any time with effect for the future. We will inform you of material changes in an appropriate manner (e.g., by email or through the app). Continued use of the app after the changes take effect constitutes acceptance of the amended Terms of Use.

13. Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for all disputes with merchants, legal entities under public law, or special funds under public law is Kassel, Germany.

Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall not be affected. The relevant statutory provision shall replace the invalid provision.
